Terms and Conditions

Welcome to this website which is owned and operated by the Methodist International Church Hong Kong (“MIC,” “we,” and “us”). These Terms & Conditions (also referred to below as the “Agreement”) constitute an agreement between you and MIC, which governs the use of this website and any web page which is a part of this website, your registration with this website, your purchase of any ticket, product or service through this website or through telephone orders or otherwise, and your use (“Use”) of any of our premises in the Wesleyan House (“Venue”).

  1. ACCEPTANCE OF THE TERMS AND CONDITIONS

As noted above, by using this website, purchasing any tickets, products or services or Use of the Venue through this website, and/or registering with this website or through telephone orders or otherwise, you agree to be bound fully by the provisions below, without change, as are published at such time. You agree to use this website solely in accordance and compliance with these Terms and Conditions for which we reserve the right, in our sole discretion, to change at any time by posting a change notice or new agreement on this website.

  1. PRIVACY AND SECURITY

Please read our Personal Data Privacy Policy and Statement which is incorporated into these Terms & Conditions and governs your use of this website. By visiting this website, registering with this website, purchasing products or services, or Use of our premises through this website, you agree with and consent to our Personal Data Privacy Policy and Statement, including the information collection, analysis, and usage practices it describes. To the extent there is a conflict between the Privacy Policy and these Terms & Conditions, these Terms & Conditions will control to the fullest extent permitted by law.

  1. TERMS AND CONDITIONS GOVERNING PURCHASE OF TICKETS

(a) One-person-one-ticket One person per ticket to events offered on this website regardless of age, subject to age limit specified for each event.  Bookings will be treated on a first-come, first-served basis.

(b) Payment See Payment Options in 6. below.

(c) Free Seating All events are free seating. Please make your way early to the event to prevent disappointment. For anyone booking in excess of 10 seats and would like the seat arrangements to be reserved together, please call the MIC office (tel no. 37254600) for assistance. MIC reserves the right to assign all final seating arrangements.

(d) Number of Tickets Unless otherwise announced, each purchase is limited to a maximum of 40 tickets.  MIC may, in respect of popular events, impose restrictions on the maximum number of tickets (for example, 8 tickets) that can be purchased in each transaction on the first ticket sale date for that popular event.

(e) Sold Tickets Tickets sold are non-refundable and non-exchangeable.

(f) Confirmation of Ticket Purchase A Confirmation Email and an accompanying QR code with reconfirmation of the event, performance date, time and number of tickets will be sent to the email address provided by you. An electronic or printed QR code will be used in place of paper ticketing. If you have not received the Confirmation Email, please contact the MIC office for assistance.

(g) Booking Details on Tickets A ticket-holder may be refused admission if any details on the printed ticket have been omitted or altered or if the QR code on the printed ticket is damaged, defaced, or otherwise mutilated.

(h) Changes of Programmes MIC reserves the right to add, withdraw or substitute artists and/or vary advertised events, programmes, seating arrangements and audience capacity.

(i) Cancellation and Postponement of Programmes For any event cancelled or postponed, MIC shall be responsible for refunding the purchase price of the tickets and the refund shall be made to the holders of the Confirmation Email only.

(j) Late-comers MIC reserves the right to refuse admission by any late-comers to the event. MIC also reserves the right to determine the time at which and the manner in which late-comers are to be admitted.

(k) House Rules All tickets are sold subject to the house rules of the venue where the event takes place. Details are available or displayed at the management office or the respective venues or the Terms of Use of Venue below, as applicable.

(l) Typhoon and Black Rainstorm Arrangements For events that have not yet started:

If Typhoon Signal No. 8 or Black Rainstorm Warning is in force during the following times, the event will be cancelled as indicated:

6:00 a.m. – 10:59 a.m. – Morning events that start before 2:00 p.m.

11:00 a.m.-2:59 p.m. – Afternoon events that start between 2:00 p.m. and 6:00 p.m.

3:00 p.m. and onwards – Evening events from 6:00 p.m.

For events that have already started: When Typhoon Signal No. 8 or above is hoisted, the event must be terminated immediately and arrangements will be made for the audience to leave. When Black Rainstorm Signal is in force, the audience is advised to stay where they are until the signal is lowered.

  1. TERMS AND CONDITIONS GOVERNING MIC PRODUCTS AND SERVICES
 

(a) Product Descriptions We work hard to be as accurate as possible. The products and services offered for sale or for fundraising through the use of this website contain descriptions that are provided by our supplier or vendors. We do not warrant or represent that such descriptions are complete and accurate. Errors will be corrected when discovered and we reserve the right to revoke any stated offer and to correct any error, inaccuracy, or omission (including after an order has been submitted by you or an order confirmation has been sent by us). If a product offered by us is not as described, your sole remedy is to return it to the MIC office in unused condition. We also reserve the right to limit the order quantity on any item.

(b) Payment See Payment Options in 6. below.

  1. TERMS AND CONDITIONS OF USE OF VENUE

Interpretation

(a). In these Terms and Conditions of Use:

(i) ‘User’ means a person, company, or organization who has applied via this website or otherwise, and approved by MIC, to use the Venue.

(ii) ‘Manager’ means MIC’s Event Manager authorised to discharge his / her functions under these Terms and Conditions of Use.

(iii) ‘Venue’ means the room(s), studio(s), hall(s), chapel(s) or any other spaces of the Wesleyan House approved by MIC for use by the User.

(iv) ‘Agent’  means any person, companies or organisations who participated in the activities of the User at the Venue.

b. Rights of MIC

(i) MIC may, at its discretion, accept or reject the application for use without giving a reason for doing so.

(ii) MIC’s own venue needs have an overriding priority over external bookings. Should there be a need, the Manager reserves its right to call back the Venue and the User will receive a full refund without compensation.

(iii) The Manager, or any person duly authorized by him/her, shall have the right to enter the Venue at all times, whether during the event or not, to ensure compliance with the Terms and Conditions of Use by the User.

(iv) The Manager shall have the right to make any live or taped announcement on the public address system in the Venue or MIC premises or display on any screen within the Venue relating to crowd control or emergency as the Manager may in its sole determination consider necessary.

(v) The Manager reserves the right to annul any event at any time during the usage period if these Terms and Conditions of Use are breached. In such circumstances, no refund will be made.

(vi) MIC reserves the right (without liability to the User) to prevent access or to remove from the Venue any person or persons acting in a way which in its opinion may cause a breach of the peace or may be harmful, undesirable or offensive or poses an actual or potential security risk or who is in material breach of these Terms and Conditions of Use.

c. Application for Use

(i)  The User is required to check the availability of venue(s) by submitting the Venue Booking Form. Telephone reservations will not be accepted. Venue Booking Form can be obtained either from this website or the Manager at the MIC office by fax or by e-mail upon request.

(ii)  The User should return the completed Venue Booking Form to the Manager either by fax, email or in person. The User may be required to provide written documents / information, such as (i) Business Registration Certificate / Society Registration Certificate; (ii) Charitable Institutions and Trust Registration Certificate issued by the Inland Revenue Department under Section 88 of the Inland Revenue Ordinance, (iii) an authorised representative of the User (with full power to act on its behalf during the Usage Period) to be available for consultation with the Manager, (iv) all publicity material, entrance passes or any other material it intends to produce (this includes invitations, PR statements and web announcements), (v) a detailed program and / or (vi) any sponsor associated with the proposed function to show that the status of the User’s organization / company, nature of business and proposed functions to be held in the Venue is law abiding and in line with MIC’s management principles and not in conflict of interest with MIC. Without sufficient documents / information provided, the application will not be approved. 

(iii)  A request made does not guarantee a space, even if available at the time of the request. The User will be notified of the application result in a written “Confirmation of Venue” as soon as the final decision is made subject to the completeness of relevant documents or information provided.

(iv)  The User warrants that there are no material facts or circumstances in relation to the proposed function to be held in the Venue which have not been fully disclosed in writing to MIC which, if disclosed, might reasonably have been expected to affect MIC’s decision to permit the use of the Venue.

d. Payment Booking will only be secured after full payment is received and “Confirmation of Venue” is sent out. For booking made by overseas User, full payment must be paid to MIC in Hong Kong Dollars. MIC will not be responsible for any surcharge levied by banks or financial institutions. See also Payment Options in 6. below.

e. Cancellation Cancellation of booking will only be accepted in writing and must reach the Manager at least 20 working days or more prior to commencement of the usage period, otherwise, no refund for such a cancellation of booking will be made. The proportion of refund will be made in accordance with the following:

(iii) Room Bookings

f. Refund Should there be a cancellation, postponement, or any problem which requires a refund, the Manager shall seek the decision from MIC’s Finance Committee. For the avoidance of doubt, any liability of MIC is limited so that its total liability shall be limited to the usage cost for the Venue.

g. No Show In the event the User or his Agent fails to appear on the usage period, MIC shall be entitled to forfeit all payments as if the agreement had been fulfilled. Should the User or his Agent like to re-arrange another date of booking, a new payment is required.

h. Overrunning The User will be responsible for payment of extra usage hours, air-conditioning and support personnel and must make payment within fourteen (14) days of receipt of an invoice from MIC. Fractions of a usage hour will be charged as a full hour’s usage.

i. Subletting Except with the prior written permission of the Manager, the User shall not assign or transfer the benefit of the agreement created herein or assign or allow the use of any part of the Venue to or by a third party.

j. Transfer of Booking The period of use or any dates within a period of use cannot be transferred to or exchanged for another date(s) or Venue(s) upon receipt of “Confirmation of Venue” and even though payment is not settled. The Manager reserves the right to approve special cases.

k. Use of a Venue The Venue shall only be used for the purpose stated on the Venue Booking Form and according to the User’s detailed program, if any, provided to MIC.

l. Publicity The name of MIC shall not be used in conjunction with the activities of the User without the prior written approval of the Manager.

m. Parking Parking is not available for the User or his Agent.

n. Delivery and Storage of Goods Materials delivered to MIC premises when the User is not in the building will not be accepted unless prior arrangements have been made and approved by the Manager. In accepting delivery of goods addressed to the User, neither MIC nor the building management shall be liable for any loss or damage. The User assumes all responsibilities for any property that may be placed in storage during or before and after the usage period.

o. Cleaning The User is responsible to keep all furniture, fittings, fixtures, carpets, the wall and the floor in any part of the Venue or the Wesleyan House to which the User and Agent have accessed in a clean, undamaged and tidy condition . All equipment borrowed must be kept and returned in a workable and clean condition. All carton boxes and miscellaneous items must be removed from the public place or kept out of public view.

p. Filming, Photography and other Recordings Any form of recording of an event in the Venue by or on behalf of any person shall be subject to MIC’s prior written approval. If MIC gives permission, the User shall not, and shall also ensure that those participating in the filming in MIC premises shall not invite or allow any person not directly involved with its filming. This includes any member of the media other than those directly involved in such production or filming. As soon as reasonably practicable after the event, the User shall arrange for a copy of all film, photographs and other recordings taken to be supplied to MIC at the User’s expense and to ensure that all necessary consents are obtained for MIC to utilise all or any such photographs, film or other recording for such purposes as it may reasonably require. MIC (or any party authorized by it) may record and/or photograph the event or any associated activities by any means. MIC shall have the right to use such recordings and/or photographs in any manner that it, in its sole discretion, deems fit.

q. Restrictions on use The User or his Agent must strictly comply with these Terms and Conditions of Use and refrain from the following activities in MIC premises and by its entrances / exits unless with the prior consent of the Manager or they shall be expelled from MIC’s premises without notice or warning and compensation:

(i) Cooking and consumption, or sale of food, alcohol, tobacco and beverage.

(ii) Alter the original seating arrangement.

(iii) Cash / cheques transaction, recruitment, fundraising campaign, market research study or of any kind.

(iv) Collections, donations or solicitations of money, goods / souvenirs / articles / programmes or services.

(v) Self-bringing audio visual equipment.

(vi) The number of persons to use the Venue will not exceed the maximum capacity stated by MIC.

(vii) Sound / music emitted from the video display / performance, PA system or any audio visual equipment must be kept to a level which can be heard only in the Venue. MIC has the right at any time to lower or turn off the equipment if the sound levels, type of and context of sound are considered to be not appropriate.

(viii) Display of decoration of any kind, banner, poster or any other kind of publicity material.

(ix) Affix glue, scotch-tape, gum paper, nails, staple or any other thing on any plaster wall or floor or on any fixtures, fittings or furniture.

(x) Any smoke, flame or explosion or device or substance or matter causing smoke, flame or explosion to create effects; party cannon, confetti cannon and confetti shooter alike are restricted to be used in all of MIC premises.

(xi) Inflammable substance or highly inflammable spirit is brought into any part of the Venue or Wesleyan House.

(xii) Using the Venue or any part of it for any activities which are dangerous, offensive, noxious, illegal or not in compliance with any law or regulation or immoral or inconsistent with the Methodist mission or which are or may become a nuisance to MIC or the owner/occupier of any neighbouring property or which may invalidate any insurance maintained for Wesleyan House or which may increase any insurance premium thereof.

(xiii) Blocking any fire alarms, extinguishers, fire hydrants, sprinkler system valves, house telephones and fire doors in the Venue, together with their control switches.

r. Additional Services If any Additional Services such as catering services and/or audio-visual services are required for the event, the User shall confirm the same to the Manager at the time of booking or as soon as reasonably practicable thereafter. The User is permitted only to use a provider authorized by MIC, to provide Additional Services, except as MIC may otherwise agree in writing. These Terms and Conditions of Use shall apply to the provision of the Additional Services. If any items including equipment, table linen, furniture, glasses, cutlery and crockery are damaged or removed during their use or are not re-usable because of loss or damage, the User shall pay the full costs of repair or replacement.

s. Cost of Repairs It shall be the responsibility of the User to bear the cost of repairs to or replacement of any equipment, furniture, fixtures, fittings or other property damaged, destroyed (fair wear and tear excepted) or removed during the period of use of the Venue by the User. Such cost shall, in the first instance, be deducted from the security deposit paid by the User.

t. Damage to or Loss of Property and Accidents The Church shall not be held responsible for any accident, death, injury, theft, loss or damage which may occur during the period of use of the Venue by the User and his Agent.

u. Indemnity The User shall indemnify MIC against all claims, demands, loss, damage, actions or proceedings, and costs (legal or otherwise) on a full indemnity basis brought against or suffered by MIC as a result of or relating to the damage, loss, theft or accidents referred to above and any breach by the User or his Agent of these Terms and Conditions of Use or any claim made against MIC by any third party arising out of or in connection with the use of Venue or the event held therein save and except to the extent, in the case of the said damage, loss, theft or accidents, such loss or accidents were directly caused by the negligence of MIC, its employees, agents or contractors in which case, MIC’s liability is limited to the amount paid by the User for the booking of the Venue.

v. Insurance The User bears the liability of having placed appropriate insurance to cover all eventualities during the use of the Venue including third party liability insurance and any damage to church property.

v. Royalties The User shall be responsible for the payment of all royalties or any other sums due to any party in connection with any exhibition or performance which they are presenting.

x. Closure, Breach of Terms and Conditions of Use

(i) MIC reserves the right to close the church premises or any part thereof, including but not limited to the Venue or any walls and/or external walls of the premises, at any time from use by the User or from use for the purpose for which the Venue is booked, or by notice to the User, cancel the confirmed booking or any part thereof, in which circumstances, subject to these Terms and Conditions, the usage cost paid by the User shall be refundable.

(ii) MIC shall not be liable for any loss or damage whatsoever suffered by the User, including but not limited to any consequential loss of profit or income and/or damage suffered due to claims made by third parties against the User, arising out of such closure and/or cancellation, if :-

(aa) the cause of the closure and/or cancellation is due to any emergency or circumstance beyond its control which are deemed to include, but not limited to the following:

(i)  damage or destruction to the church premises or any part thereof which the Manager considers in his/her sole opinion that it would be dangerous to any person, entering and/or remaining in the premises or any part thereof;

(ii) flooding in the premises or any part thereof or the vicinity or the neighbourhood around the premises and/or;

(iii) the suspension of electricity or air conditioning to the Venue,

OR

(bb) such cancellation relates to any booking for the use of any wall or external wall of the church premises for the purpose of displaying any banner, poster, advertisement or board, and in the event of such cancellation, the User shall immediately upon the day of receipt of the notice of cancellation, or within the time specified in such notice, at the User’s cost, remove such banner, poster, advertisement or board as well as reinstate the wall and/or external wall upon which the same has been displayed to its  condition prior to the display, and should the User fail to do so, the Manager shall have the full right to effect such removal and reinstatement without being responsible for any loss and/or damage to such banner, poster, advertisement or board and the User shall pay MIC the cost incurred in effecting such removal and reinstatement.

(iii) If the User shall fail to pay the usage cost on any of the dates set out in the “Confirmation of Venue” or observe or perform any of the provisions of these Terms and Conditions of Use, the Manager may, without notice, cancel the confirmed booking and terminate the usage period of the Venue and, without prejudice to other remedies MIC may have hereunder, any usage cost paid by the User shall be forfeited. The Manager shall not be liable to the User for any loss or damage whatsoever arising out of such cancellation, to include but not limited to any consequential loss of profit or income or damage suffered due to claims made by third parties against the User.

(iv) If during the usage period, the Venue is affected by any emergency or circumstance beyond MIC’s control such as flooding or suspension of electricity or air-conditioning, but the Venue is not closed or booking cancelled, no refund of the usage cost shall be payable by MIC.

y. Typhoon and Black Rainstorm Arrangements The terms in 3(l) above shall apply to bookings for events under these Terms and Conditions of Use except that reference to “audience” shall mean the User and his Agents. If the Typhoon Signal No. 8 is hoisted during the event, the User shall be entitled to cancel the booking on that day and the User must contact the Manager to book an alternative date provided the date is within 2 months after the usage period and the Venue is still available. No refund will be made and MIC reserves the right to refuse an alternative event date if its schedule or other considerations do not allow. These Terms and Conditions of Use will apply to any rescheduled booking.

5. PAYMENT OPTIONS Payments can be made using the credit cards or Fast Payment Service as specified on the relevant webpage. We are unable to accept non-online orders or payment by cheque or cash unless otherwise specified. Payment for booking of Venue, unless otherwise specified, can be made by cash, bank transfer or by crossed cheque in Hong Kong Dollars in favour of “Methodist International Church, Hong Kong”.

6. PROPER USAGE You agree to use this website, and to purchase tickets, products and services through the use of this website, only for your own personal, noncommercial use. You agree not to use this website (a) in any unlawful manner or in any manner that creates civil or criminal liability on the part of MIC or is otherwise harmful to MIC; (b) in any manner that could damage, disable, overburden, impair, impede, disrupt, or alter this website; and (c) in any manner that would interfere, impair, impede, or disrupt the use of this website by any third party. You agree not to post on or transmit through this website or to submit to MIC for inclusion, use or distribution on this website or for any other purposes any material that is unlawful; libelous; constitutes an invasion of privacy; harmful; threatening; abusive; harassing; defamatory; vulgar; obscene; sexually explicit; profane; hateful; racially, ethnically, or otherwise objectionable in any manner; constitutes a breach of your contractual and/or fiduciary obligations; infringes on any third-party patent, trademark, trade name, corporate name, trade secret, copyright or other proprietary or property rights; or, contains viruses, Trojan horses, worms or other code, scripts, routines, files or programs designed to alter, interrupt, impede, limit or destroy the performance and/or functioning of any software, hardware, or other equipment.MIC reserves the right in its sole discretion to prohibit any conduct, communications, content, or use of this website, and to remove any content or communications, which in its sole discretion it finds objectionable or unacceptable in any manner. 

7. INTELLECTUAL PROPERTY RIGHTS MIC.com and the MIC logos are trademarks or registered trademarks owned by MIC. Other trademarks, registered trademarks, trade names, product names, corporate names, graphics and logos used on this website are owned by their respective owners. All rights in and to such trademarks, registered trademarks, trade names, product names, corporate names, graphics and logos are reserved to their respective owners. No licence or permission is given to you to use such trademarks, registered trademarks, trade names, product names, corporate names, graphics or logos in any manner. The copyright in this website and its content are owned by MIC. All rights in and to such copyrights are reserved to their respective owners. No licence or permission is given to you to use such copyrighted material in any manner. You may not remove, modify, or alter in any manner any notice regarding copyright, trademark, proprietary rights, warranty information, disclaimers, or warnings which are included in or on this website or any service or product offered for use or sale through this website.

8. DISCLAIMER OF WARRANTIES to the fullest extent permitted by applicable law, this website, the content of this website, the software utilized by this website, and all products and services offered for sale or license through this website are provided on an “as is” basis and mic makes no warranties of any kind, express or implied, regarding this website, the content of this website, the software utilized by this website, or the products and services offered through this website or that this website is free of viruses or the like.

 

9. APPLICABLE LAW This website is created, controlled, owned and operated by MIC and governed by the laws of Hong Kong.

10. AGE OF USER If you are under the age of eighteen (18) years, you may use this website and purchase tickets, products and services through the use of this website only with the involvement and under the supervision of a parent or legal guardian.

11. TERMINATION OF USAGE MIC shall have the right at any time, with or without cause, and with or without notice to you to (i) cancel any order; (ii) terminate or suspend your right to use or access this website; or (iii) terminate or suspend your right to purchase any ticket, product or service through the use of this website.

12. MISCELLANEOUS PROVISIONS All terms and conditions contained herein are severable and in the event any of them shall be held to be invalid, this Agreement shall be interpreted as if such invalid term or condition were not contained herein. Headings used in this Agreement are for convenience only and shall not affect the interpretation or construction of this Agreement. Any failure by MIC to enforce any provision of this Agreement shall not constitute a waiver of such provision nor prejudice MIC’s right to enforce the provision at any subsequent time. All orders are subject to acceptance of MIC.
